The new Collective Bargaining Agreement for the Metalworking and General Mechanical Engineering Industries (CC-MIMG) took effect on July 1, 2011.
Article 33/34: Absences Due to Illness or Non-Work-Related Accidents
Absences justified by incapacity resulting from non-work-related illness or accident do not constitute grounds for termination of the employment contract, provided such absences do not exceed twelve (12) months.
An employee whose employment contract is suspended due to illness or a non-work-related accident shall retain their full salary for the first six (6) months and 50% of their salary for the last six (6) months of their absence.
Article 36/37: Notice Period for Permanent Contracts
Either party may terminate a permanent employment contract upon written notice to the other party, with a minimum notice period of:
· 8 days for day laborers or temporary workers,
· 1 month for laborers and employees,
· 2 months for supervisors and technicians,
· 3 months for engineers and managers.
Article 43: Severance Pay
In the event of termination, an employee with one year of service is entitled to severance pay equal to the average salary for the last 12 months multiplied by
· 25% for each of the last 5 years,
· 30% for the period between the 6th and 10th year,
· 35% for each year beyond the 10th year.
Article 51: Continuous Operations
In companies operating continuously, including on weekends, working hours performed as part of a “shift” system with rotating day and night shifts are paid at the same rate as that provided for weekday daytime work.
Article 52: Meal Allowance
Workers who perform at least six (6) hours of night work are entitled to a meal allowance, the amount of which shall not be less than 7% of the minimum wage.
Article 53: Seniority Bonus
The seniority bonus is calculated as a percentage of the minimum wage for the worker’s pay grade as follows
· 3% after 3 years of service,
· 5% after 5 years of service,
· +1% for each year from the 6th through the 20th year, inclusive.
Article 55: Bonuses
Depending on the results achieved, bonuses are granted by management and shall not be less than one month’s net salary of the employee.
Article 61: Overtime
Overtime worked beyond the legal workweek is paid as overtime, resulting in an increase in total pay as follows:
Workdays
· 20% of the hourly wage when worked between the 41st and 48th hours.
· 35% of the hourly wage for hours worked beyond the 48th hour.
Holidays and days off
· 50% of the hourly wage during daytime hours.
· 100% of the hourly wage for night shifts.
Article 67: Special Leave and Time Off
Up to 15 days per year, workers are granted leave for family events, which must be substantiated by a civil registry document, in the following cases:
The employee’s marriage;
Marriage of the employee’s child;
Birth of the employee’s child;
Marriage of the employee’s brother or sister;
Death of the employee’s spouse;
Marriage of the employee’s brother or sister;
Death of a direct ascendant or a brother or sister.
