Job Protection Plan (PSE): Support Measures in the Event of Mass Redundancies

In a collective redundancy for economic reasons in Mali, a company can put in place financial, social and professional measures to help employees through the transition period.

Mandatory entitlements must be distinguished from additional negotiated support. Article L.48 of the Labour Code provides in particular, in addition to notice and any severance pay, a special payment equal to one month’s gross salary, as well as priority for rehiring for two years in the same category. These benefits are therefore not optional gestures.

The main additional measures available are as follows:

Additional financial support An exceptional leaving bonus, a lump sum or a top-up calculated according to length of service, on top of the amounts due.
Help returning to work CV preparation, interview practice, references and introductions to companies that are hiring.
Redeployment Searching for available positions in other establishments, group companies or partner businesses, with the employees’ agreement.
Training and retraining Funding a short training course, a professional certification or learning a new trade.
Help starting a business A small grant, equipment or support to launch a self-employed activity.
Health and social support Temporary payment of health insurance, subject to the insurer’s agreement, or help with ongoing medical care.
Family support An exceptional contribution to school fees or targeted help for employees with heavy family responsibilities.
Mobility support A contribution to transport or moving costs, or to the cost of returning to one’s home area.
Psychological support Confidential interviews and support to cope with the personal consequences of losing a job.
Administrative support Explanation of the final settlement and help with social security or retirement formalities, depending on the situation.

Before any redundancies, article L.47 also requires the employer to consult the staff delegates and look for solutions to preserve jobs, including reduced hours, shift work, part-time work, temporary lay-off or redeployment.

For a company in financial difficulty, a realistic package may combine an additional bonus the company can afford, job-search support and a few targeted training courses. Support can be adjusted according to objective and transparent criteria: length of service, family responsibilities or particular difficulty in finding new work.
