Work-Related Accidents and Occupational Diseases (AT & MP)

Article 62 of the Social Security Code defines a work-related accident as any accident that occurs as a result of or in the course of work.

This includes accidents occurring at the workplace or while commuting between home and work, provided that the route is not altered for personal reasons.

In practice, the employer is required to arrange for the injured worker’s transport to the nearest health facility and to cover the cost of emergency care.

In addition, the work-related accident must be reported to the National Institute of Social Protection (INPS) within 48 hours.

Furthermore, for a worker to be recognized as having an occupational disease, the disease must be listed in the INPS’s schedule of occupational diseases, and the occupational physician must establish a current or past link to the employee’s professional activity.

A workplace accident or occupational disease results in the suspension of the employment contract until the injuries have healed or the illness has been cured.

This suspension period is fully compensated by the INPS unless the accident or illness is due to the employer’s gross negligence.

The workers’ compensation system for work-related accidents and occupational diseases is funded by a contribution ranging from 1% to 4% of gross wages, depending on the sector, which is paid by the employer.
